NOLENA FINANCE LTD and its affiliates ("Nolena Finance", "We", "Us") require that all users ("User", "You") of our internet website (collectively, the “Site”) adhere to the following Terms and Conditions.

By accessing and using the Site, you confirm that you acknowledge and accept these terms and conditions and that you agree to comply with them. If you do not agree to these terms, you must not use the Site.

2. Description of Services

The Company operates as a registered Money Services Business (MSB) and Payment Service Provider (PSP) in accordance with applicable Canadian legislation. Services include:

  • Money Transferring Services: Facilitating fund transfers between parties, including cross-border transactions.
  • Virtual Currency Services: Enabling the purchase, sale, and transfer of virtual currencies (on-ramp and off-ramp).
  • Payment Service Provider (PSP) Services: Specialized payment processing and settlement solutions.
  • Foreign Exchange Services: Currency exchange in connection with money transfers or virtual currency operations.

The Company is not a bank. We do not provide payment accounts within the meaning of the Payment Services Directive, do not issue electronic money, and do not offer IBANs or traditional banking deposit services.

3. Eligibility and Onboarding

To utilize our Services, the Customer must be a business entity, individual entrepreneur, or an authorized representative thereof. We are required to conduct mandatory Customer Due Diligence (CDD) and ongoing monitoring in accordance with Anti-Money Laundering (AML) and Counter-Terrorist Financing (CTF) legislation.

You authorize us to obtain information from third-party agencies for verification and risk assessment purposes. We reserve the right to refuse or suspend services at our sole discretion if compliance requirements are not met.

4. Intellectual Property

Nolena Finance is the owner or licensee of all intellectual property rights on the Site. This includes all data, graphics, text, and software. You may not conduct any text or data mining, web scraping, or use automated "bots" to access or monitor the Site without express written consent.

5. Limitation of Liability

In no event shall Nolena Finance, its directors, or employees be liable for any indirect, special, incidental, or consequential damages, including loss of profit or business interruption, arising out of your use or inability to use the Site. All content is provided "as is" without warranties of any kind.

6. User Responsibilities

  • Security: You must keep your account credentials confidential.
  • Technology: You are responsible for configuring your own virus protection and IT security.
  • Lawful Use: You warrant that you will not use the services for fraudulent or illegal activities.

7. Governing Law

These terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein. Users irrevocably agree to the exclusive jurisdiction of the courts of British Columbia.
